High court to hear NJ housing discrimination case

WASHINGTON (AP) -- The Supreme Court agreed Monday to take another dispute involving race, deciding whether people must prove they were victims of intentional housing discrimination to win lawsuits under federal law.

With highly anticipated decisions on affirmative action and voting rights imminent, the justices added a case to their calendar for the fall that involves the Fair Housing Act, which bars discrimination on the basis of race, among other categories, in residential property sales and rentals. The issue in the case is whether it is enough to show that a practice has a disproportionate effect on a group or whether there must be proof of intent to discriminate.

The outcome also could affect other laws, including one that prohibits discrimination in lending and is enforced by the Consumer Financial Protection Bureau.

African-American and Hispanic residents of a neighborhood pegged for demolition and redevelopment in Mount Holly, N.J., sued to block the project, saying it targeted a predominantly minority area.

Unlike other anti-discrimination laws, the housing act does not explicitly cover disparate impact claims.

The housing law prohibits discrimination in all sorts of transactions involving real estate and applies to banks and mortgage companies as well as governments, like the one involved in this case.

The Obama administration tried to ward off high court review by telling the justices that the Housing and Urban Development Department has recently adopted a new regulation to deal with the sorts of claims at issue in the case and that no federal appeals court has yet addressed the new rule. The administration also said that 11 federal appeals courts have held that the law does allow for claims based on the results of a project or practice, not just intentional discrimination.

The court originally agreed to take up the issue in 2011 in a case from St. Paul, Minn., questioning whether the city's enforcement of its housing code in low-cost rentals disproportionately occupied by African-Americans violated the fair housing law. But Justice Department lawyer Thomas Perez, now nominated to serve as Labor secretary, prevailed on St. Paul to withdraw its appeal because the outcome could have harmed the department's approach to housing discrimination cases.

Republicans have criticized Perez for his role in a deal between the department and St. Paul that also kept the federal government out of two whistleblower lawsuits against the city that could have returned millions of dollars in damages to the federal government.

In Mount Holly, the township has been trying since 2002 to clear the Mount Holly Gardens neighborhood, described by the municipality as "problematic" for many years because of high crime, poor maintenance and overcrowding. Blacks and Hispanics made up three-quarters of the area in the 2000 census. In all, Mount Holly is about 60 percent white.

The residents and former residents who sued claimed that much higher percentages of Mount Holly's black and Hispanic households would be affected by the redevelopment than would white households. Conversely, a far larger share of white residents would be able to afford the new housing, the plaintiffs said.

The 3rd U.S. Circuit Court of Appeals in Philadelphia agreed that the residents had made enough of a claim to go to trial on the disparate impact of the township's plan. But the court also found that there was insufficient evidence of intentional discrimination.

The case, Township of Mount Holly v. Mount Holly Gardens Citizens in Action, 11-1507, will be argued in the fall.

Yesterday, at the exterior of a grocery store, I got a small cut on my right hand by slightly hitting a shelving unit. This was metal shelving unit, with a lot of rust. So basically, I cut myself with rusty metal. I got to drug store to buy some cotton and hydrogen peroxyde, so I desinfected the cut after a few minutes.
So now I'm worried about tetanus, pale, I did get a shot one year ago, but no protection is perfect and I'm still worried. What should I do? Should I go to the clinic? And could they do something?

if you got a tetanus shot one year ago and have cleaned the cut and it has stopped bleeding, there is nothing more a clinic could do. try not to worry and get a good night's sleep.

you can go and get a tetanus shot to stop future incidents, I get one every few years because I spend time around rusty metal

You should try to relax and realize that thousands and thousands of people everyday cut themselves on metal objects and don't get tetanus.

Bank of England's Tucker to leave after losing out to Carney

LONDON (Reuters) - Bank of England Deputy Governor Paul Tucker, beaten to the central bank's top job by Mark Carney, will stand down later this year, giving the Canadian an early chance to help reshape the BoE's upper echelons.

Tucker, part of the majority of BoE policymakers that opposes further bond buying, had been expected to leave ever since Carney, the former head of Canada's central bank, was named in November as the surprise choice for governor.

Carney will replace Mervyn King, who retires from the Bank at the end of this month.

But the timing of the announcement took some by surprise - Tucker's term was due to end next February - and might be a sign that other top policymakers will bring forward their departures, said Tom Vosa, an economist at National Australia Bank.

"The interesting bit will be whether the replacement is an internal or external candidate, which will probably give you some clues as to how Carney expects to position the bank under his governorship."

Carney will head up a central bank that now has much greater powers, and he is widely expected to start giving markets guidance on monetary policy soon after he takes over.

He has already decided to bring his former chief spokesman from the Bank of Canada with him, in a possible sign he may pursue a more open communications style than King and that more external appointments are in the pipeline.

The decision on who will replace Tucker, who specialises in financial stability, falls to Britain's Chancellor, George Osborne, who is widely expected to consult Carney before picking a candidate.

Barclays economist Simon Hayes said the biggest challenge facing the Bank over the next few years is to ensure monetary policy and regulation of the financial sector are joined up.

"The new deputy governor will be pivotal in this process, and the ability to take the (BoE's) fledgling Financial Policy Committee forward and to engineer an effective link-up with the Monetary Policy Committee is probably a more important selection criterion than their view on the current monetary stance."

Tucker is likely to stay on at the Bank for the first months of Carney's term, which starts on July 1, and the exact date of his departure will be confirmed in due course, the central bank said in a statement.

When Osborne announced Carney's appointment in November, he said he hoped Tucker would continue to work for the Bank.

But the disappointment of losing out on the governorship was widely seen as too bitter for Tucker, who has been with the bank for more than 30 years.

Tucker, who specialises in financial stability, had been seen as a strong candidate to succeed King.

But his chances took a knock in July last year when the Bank came under fire for failing to act on signs a few years earlier that banks had been rigging the LIBOR interbank interest rate.

Tucker was the BoE's executive director for markets at that point and was in close contact with Barclays chief executive Bob Diamond, who later resigned over the scandal.

Tucker came under pressure over his apparently chummy relationship with Diamond.

Diamond said in an email after Tucker was promoted to deputy governor in December 2008: "Congratulations. Well done, man. I am really, really proud of you." Tucker replied: "Thanks so much Bob. You've been an absolute brick through this."

Alan Clarke, an economist at Scotiabank, said there was a risk that senior BoE staff were demotivated by the appointment of an outsider like Carney and that the bank should be prepared to promote its own staff.

"I think they need to send a signal to bank insiders that there is room for internal promotion. You've got brilliant people at the Bank of England being lured away to investment banks," he said.

Tucker plans to spend a period of time in academia in the United States, the bank said.

The Chancellor said in November that Charlie Bean, a fellow BoE rate setter and another deputy governor, would serve an extra year until mid-2014 to help Carney settle in to his new role.

Weed Control and Grub Worms In the Lawn - SubmitYourArticle.com

You'll soon learn that ANY weed can be taken care of if YOU take care when selecting your products. In this section, I'll discuss the main types of herbicides you'll need, tips on how to select them, and proper methods of application. The basic four types.

Broadleaf - selective liquid herbicide

When properly selected, covers ALL types of annual broadleaf weeds. Does not include broadleaf perrenials such as wild violet, creeping charlie, and wild strawberry.

Grassy weed - selective liquid herbicide.

A pre-emergent should be applied when the soil temperature reaches 51 degrees. This is because grassy weed seeds (which there are MILLIONS of in every yard) germinate between 51 and 55 degrees. An effective pre-emegent, when properly timed, will stop about 80 percent of grassy weeds from germinating. Try and find a granular as it will last longer. Post emergent herbicide should be applied promptly do deal with most types of grassy weeds. The only exeptions to the rule are nutsedge, bermuda, and zoysia. Many times repeat applications are necessary. If the lawn is checked weekly, grassy weeds won't be a problem into the summer.

Selective Nutsedge Herbicide.

This one's important. If you have nutsedge, or you've seen it anywhere near your property, you need to have this on hand. Nutsedge is a nasty, quick growing, quick spreading, menace. It grows 5 times faster than turf grass. It spreads quicker when you pull the tops. It goes to seed in four days flat! Apply generously, repeat, repeat.

Round it Up!

If all else fails, round it up! Necessary for wild violets and strawberries, bermuda grass, zoysia grass, and creeping charlie. Destroy a 5 foot perimeter. Wait 6 weeks. Destroy it again if needed.

And that's weed control!

Beetle larvae that are small (1/2-1 inch long) and white are commonly known as "white grubs" The worst pests include the Asiatic, June and Japanese beetles as well as masked chafers. Starting in spring, as newly hatched larvae, they eat the grass roots of the lawn, decreasing the turf's tolerance to minor drought, heat and other stresses. The grubs create wilted and dry patches that can eventually lead to the plants dying off.

As grubs can live as far as 6 inches under the soil, a long acting pesticide is needed. I hate to be repetitive but, slow release granular will do the trick. Apply at the begining of the summer, and check to see if repitition is needed in the early fall.

If you are getting large circular patches of dead grass that pull up like carpet, you've got grubs!

The correct way to check for grubs in your. If you have more than 6 grubs in 1 square foot, your lawn is in serious danger.

Check often as grubs can do hundreds of dollars worth of damage overnight.

iTunes Radio? Pandora And Slacker Are Not Impressed

itunes radioApple unveiled its long-rumored iRadio, er, iTunes Radio service this morning at the Worldwide Developers Conference. Now that we know the basics of the streaming music service (which is supposed to launch this fall), one of the obvious questions is: What does this mean for existing Internet radio/online music services like Pandora and Spotify? Well, I emailed Pandora, Rdio, Slacker, and Spotify to see what they thought. Spotify declined to comment, and Rdio says it's still working on something (I'll update this post when I get it), but the other services all sent me brief statements. There are no huge surprises, and yes, the dreaded "validate" word gets trotted out once. Even so, there's some entertaining talk about why they're not feeling too threatened by the news.
